2. Face Data Collection, Use, Disclosure, Sharing, and Retention

2.1 What Face Data Does the App Collect?

When you use the face scanning feature, MySkincare collects three (3) photographs of your face taken from different angles. These photographs contain facial features and biometric data that constitute "face data" as defined by applicable privacy laws.

2.2 Complete Explanation of All Planned Uses of Collected Face Data

The face data collected is used exclusively for:

  • Skin Analysis: To analyze skin conditions including redness, texture, tone, and other visible skin characteristics
  • Progress Tracking: To enable you to track changes in your skin condition over time by comparing scans stored locally on your device
  • Personalized Recommendations: To provide personalized skincare insights based on your skin analysis

We do NOT use face data for: facial recognition, identity verification, building facial recognition profiles or databases, training public datasets or machine learning models, marketing, advertising, or sharing with data brokers.

2.3 Third-Party Sharing and Storage of Face Data

Face data is temporarily transmitted to our AI/Vision processing provider (e.g., OpenAI or similar service providers) solely for the purpose of immediate analysis. This transmission occurs over encrypted connections (HTTPS/TLS). Face data is NOT stored on our servers or the servers of our processing providers - it is processed and immediately deleted.

Face data is NOT shared with: Supabase/Firebase, RevenueCat, Superwall, data brokers, advertisers, or any other third parties.

2.4 Face Data Retention Period

Face data is NOT stored on our servers. Face data is deleted immediately after each scan completes (typically within seconds).

Face data is stored ONLY on your personal device. You have full control over this data and can delete it at any time through the app or by uninstalling the application.

Summary: Face data is deleted from all servers immediately after each scan completes. The only copy of your face data that persists is the one stored locally on your device, which you control and can delete at any time.

3. Interpretation and Definitions

3.1 Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

3.2 Definitions

  • Account: A unique arrangement for You to access our Service (if applicable).
  • Company: Refers to MySkincare ("we", "us", or "our").
  • Country: Refers to the jurisdiction where the Company operates.
  • Device: Any device that can access the Service such as a smartphone or tablet.
  • Face Data: Photographs of your face containing facial features and biometric data collected when using the face scanning feature. Face data includes three (3) photographs taken from different angles.
  • Personal Data: Any information that relates to an identified or identifiable individual.
  • Service: Refers to the MySkincare mobile application.
  • Service Provider: Any natural or legal person who processes data on behalf of the Company.
  • Usage Data: Data collected automatically from Service use.
  • Scan Data: Images or photos uploaded by You for the sole purpose of immediate processing.

4. Information We Collect

4.1 Onboarding Data

We collect specific data points during the onboarding process to tailor the user experience. This includes:

  • Skin type (e.g., Oily, Dry, Combination)
  • Skin concerns (e.g., Acne, Wrinkles)
  • Age range
  • Gender

4.2 Usage Data

  • Feature usage patterns
  • In-app interactions
  • Device type and OS version
  • IP address and generic location data (Country/Region)
  • Anonymous analytics (e.g., session duration)

4.3 Face Data

When you use the face scanning feature, the app collects three (3) photographs of your face taken from different angles. This face data is used to analyze skin conditions including redness, texture, tone, and other visible skin characteristics.

We do NOT store face data on our servers. Face data is deleted immediately after each scan completes. Face data is temporarily transmitted to our AI/Vision processing provider solely for immediate analysis, then immediately deleted.

Face data is stored ONLY on your personal device. You have full control over this data and can delete it at any time through the app or by uninstalling the application.

3.4 What We Don't Collect

  • We do not permanently store your face data or photos on our servers.
  • Phone numbers.
  • Physical addresses.
  • Payment information (all transactions are processed securely by third parties like Apple or Google).

5. Use of Your Personal Data

We use Your data for the following purposes:

  • To Provide Core Functionality: Processing your face data and skin input to generate analysis results, including analysis of redness, texture, and other skin characteristics.
  • To Personalize the Experience: Using onboarding data (skin type, age) to filter results relevant to you.
  • To Enable Progress Tracking: Allowing you to compare face scans over time to track changes in your skin condition. This comparison is performed locally on your device using the face data stored on your device.
  • To Improve the Service: Analyzing anonymous usage trends to fix bugs and improve app performance. Note: Face data is NOT used for service improvement as it is not retained.
  • To Manage Subscriptions: If you purchase a premium version, data is used to validate your purchase status.

6. Data Sharing & Third Parties

6.1 Service Providers

We may share data with the following third-party vendors solely to provide the Service:

  • Supabase / Firebase: For database management and authentication (if applicable). Face data is NOT shared with these providers.
  • AI/Vision Processing Providers (e.g., OpenAI): Face data is temporarily transmitted to these providers solely for immediate processing of skin analysis. Face data is deleted immediately after processing completes.
  • RevenueCat: To manage in-app subscriptions and purchase infrastructure. Face data is NOT shared with RevenueCat.
  • Superwall: To manage paywalls (if applicable). Face data is NOT shared with Superwall.

Important: Face data is ONLY shared with AI/Vision Processing Providers for temporary processing and is immediately deleted thereafter. Face data is NOT shared with any other third parties.

5.2 Business Transactions

If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

5.3 Legal Requirements

We may disclose Your Personal Data if required by law or in response to valid requests by public authorities.

7. Data Retention

  • Onboarding Data: Retained only as long as you use the app to maintain your preferences. You may request deletion of this data at any time by contacting us.
  • Face Data: Face data is NOT retained on our servers. It is deleted immediately after each analysis completes. Face data is stored ONLY on your personal device, and you can delete it at any time through the app or by uninstalling the application.
  • Analytics: Aggregated and anonymized data is retained for analytical purposes to improve the Service. Face data is NOT included in analytics.
  • Subscription Data: Retained as long as necessary to manage your subscription and comply with legal obligations.

8. Data Security

We implement appropriate technical and organizational security measures to protect your Personal Data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

Security measures include:

  • Encryption of data in transit using secure protocols (HTTPS/TLS)
  • Secure authentication and access controls
  • Regular security assessments and updates
  • Limited access to Personal Data on a need-to-know basis

While we strive to protect your Personal Data, you acknowledge that you provide information at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Service).

You expressly agree that your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no warranty that the skin analysis is accurate, complete, or suitable for any medical purpose.

10. Your Rights

Depending on your location, you may have rights regarding your data:

  • Access/Delete: You may request the deletion of your onboarding data by contacting us.
  • Local Storage: If data is stored locally on your device, you can delete it by uninstalling the application.

11. Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13.

12. Changes to This Policy

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date.
